Child adoption from Pakistan: the document checklist for overseas families
Most delays in a guardianship case are not legal arguments — they are a missing certificate or an unattested copy. This is the checklist we give families living abroad before we file.
Pakistan has no adoption statute. What families call “adoption” is, in law, a guardianship order made by a Guardian Judge under the Guardians and Wards Act, 1890. Because the case runs in a Pakistani Family Court while the family usually lives abroad, the paperwork has to be right the first time. Here is the full list, grouped by who provides it.
1. Documents from the prospective guardians
- Passports, and CNIC or NICOP where held
- Marriage certificate (for a couple)
- Proof of income and employment — salary letters, tax returns or bank statements
- Police character certificates from the country of residence
- Medical fitness certificates
- Recent photographs
- An undertaking on the child’s welfare, upbringing and education
- A home study report, where the destination country requires one for the child’s immigration
2. Documents about the child
- Birth record, where one exists
- For a child from an orphanage or welfare organisation: the institution’s record of the child and its written consent or no-objection
- For a child from a known family: the biological parents’ consent and identity documents
3. The court stage in Pakistan
- A power of attorney so that counsel can file and appear while you are abroad
- The guardianship petition before the Guardian Judge
- The guardianship order — and, if the child will live abroad, express permission in the order to take the child out of Pakistan
4. After the order
- Child Registration Certificate (Form-B) from NADRA
- The child’s Pakistani passport
- Attestation by the Ministry of Foreign Affairs and an apostille where the destination country accepts one (Pakistan joined the Apostille Convention in 2023)
- The destination country’s visa or immigration approval for the child
Two points that save months
Check the destination country first. The UK, the US, Canada, Australia and the Gulf states each treat a Pakistani guardianship order differently for immigration. Confirm the route with your immigration adviser before the petition is filed, so the order contains what that route needs.
Attest early. Documents issued abroad generally need attestation before a Pakistani court will rely on them. Start this while the rest of the file is being prepared.
Frequently asked questions
Do we have to be in Pakistan for the whole case? Usually not. With a properly executed power of attorney, counsel can run most hearings; the court may still require a personal appearance at key stages.
Is a guardianship order the same as adoption abroad? No. It gives custody and legal responsibility, not a change of parentage. Whether your country converts it into an adoption depends on that country’s law.
How long does it take? It depends on the court, the completeness of the documents and the destination country’s process. A complete, attested file is the single biggest factor in avoiding delay.
