Divorce, khula and custody in Pakistan, when one of you lives abroad.
For Pakistani spouses and parents in the UK, Europe, North America, Australia and the Gulf whose marriage, divorce or children’s case has to be dealt with in Pakistan.
Short answer. A husband living abroad can pronounce talaq and have the notice under section 7 of the Muslim Family Laws Ordinance, 1961 served on the Union Council chairman and the wife through an attorney in Pakistan; a wife living abroad can seek khula or dissolution from a Family Court, usually through a special attorney, although the court can require her attendance or evidence by video link. Custody is decided on the child’s welfare under the Guardians and Wards Act, 1890. Whether any of this is recognised where you live is a question of that country’s law.

What we handle.
Talaq notice and effectiveness
Drafting and serving the section 7 notice on the Union Council and the wife, attending the arbitration council, and obtaining the Union Council certificate and NADRA divorce certificate.
Khula and dissolution
Suits before the Family Court for khula, or for dissolution on the statutory grounds in the Dissolution of Muslim Marriages Act, 1939, including cruelty, desertion and failure to maintain.
Dower and maintenance
Claims for unpaid dower (haq mehr), maintenance for wife and children, and recovery of dowry articles, filed in the Family Court for a spouse living abroad.
Custody and visitation
Custody petitions and visitation schedules under the Guardians and Wards Act, 1890, including video contact for a parent abroad and orders on travel with the child.
Children taken across borders
Urgent custody and habeas petitions in Pakistan, and coordination with lawyers abroad under the Hague Convention or the UK–Pakistan protocol where they apply.
Marriage and divorce records
Correcting or registering nikah and divorce records with the Union Council and NADRA, which affects NICOPs, children’s documents and immigration files abroad.
Recognition abroad: read this before you file.
We are Pakistani counsel. We can make the Pakistani process correct and well documented. Whether your country recognises it is for its courts and officials.
Recognition depends on how the divorce was obtained
Several countries treat a divorce obtained through a formal procedure differently from a bare pronouncement. Following section 7 properly, with notice to the Union Council, matters for recognition as well as for Pakistani validity.
Where each spouse lived matters
Recognition rules abroad often turn on domicile or habitual residence at the time of the divorce. If both spouses have lived abroad for years, take local advice before relying on a Pakistani process.
Remarriage and immigration files
If you intend to remarry abroad, or a spouse or child visa depends on your marital status, get the local recognition question answered first. It is cheaper than a refused application.
Questions about family cases from abroad.
Often, yes. A khula suit can be filed in the Family Court through a special attorney, and courts increasingly allow statements by video link. The court must attempt reconciliation first; if that fails it can decree khula, and may order the return of dower or benefits received. The judge can still require your personal appearance.
Under section 7 of the Muslim Family Laws Ordinance, 1961, written notice of the talaq must be given to the chairman of the Union Council, with a copy to the wife. An arbitration council is formed to attempt reconciliation, and the talaq takes effect after ninety days unless revoked. The Union Council then issues its certificate, and NADRA issues a divorce certificate on that basis.
That is decided by the law of the country where you want to rely on it, not by Pakistani law. Recognition often depends on how the divorce was obtained, where each spouse lived, and whether the proper Pakistani procedure was followed. We make sure the Pakistani side is done correctly and documented; take advice from a family lawyer where you live on recognition.
The court decides on the welfare of the minor, which overrides every other rule. As a general starting point the mother has preferential custody of young children, and the father remains the natural guardian of the child’s person and property, but welfare can displace both. A parent abroad can seek custody or a visitation schedule, including video contact, through the Family Court.
It depends on your country. Pakistan acceded to the 1980 Hague Child Abduction Convention, in force for Pakistan from 1 March 2017, but it operates only with countries that have accepted Pakistan’s accession. The UK and Pakistan also have a judicial protocol on children matters. Where no treaty route applies, the remedy is a custody or habeas petition in Pakistan. Move quickly; delay weighs heavily in these cases.
