Legislative Drafting
Drafting and reviewing legislation, rules and regulatory instruments for public and private sector clients.
Legislative Drafting overview
Drafting legislation or subordinate regulation is a different discipline from drafting a contract — the text has to survive scrutiny by a legislature or a court years after it is written, and it has to interact correctly with the General Clauses Act, 1897 and whatever existing statutes and rules already occupy the same field, at both the federal and provincial level under Pakistan’s constitutional division of legislative competence. Federal bills follow the procedure set out in the Constitution of Pakistan, 1973 and the Rules of Business, 1973, while delegated legislation — the rules and regulations that give a parent statute its practical effect, of exactly the kind SECP, FBR, NEPRA, OGRA and the provincial revenue authorities issue under their own governing Acts — has to stay within the rule-making power the parent statute actually grants, or it risks being struck down as ultra vires. KBL & Associates drafts and reviews both primary legislative language for public sector clients and the regulatory instruments private sector clients need reviewed before they commit to a position, checking each draft against the statute it sits under and against how a court is likely to read it in practice.

Legislative drafting is the preparation of statutes, rules, and regulations for government bodies or private clients, requiring precision in legal language to avoid ambiguity once the text becomes binding law.

International and donor-funded work
Drafting and policy instructions come from development partners, industry bodies and sponsors outside Pakistan as well as domestic institutions. Work is delivered remotely, with consultation sessions scheduled across time zones.
Overseas instructions are a routine part of the firm’s work rather than an exception. Where a matter also touches family law — guardianship, succession or a child’s documents — it is handled by the same firm rather than referred out.
