For families living abroad

Child adoption from Pakistan if you live in the United Kingdom.

For British citizens, dual nationals and NICOP holders living in the UK who need a Pakistani Family Court to appoint them guardian of a child in Pakistan.

Pakistan-side court work, from Lahore. You stay where you live.

KBL & Associates files and argues the guardianship petition in the Family Court that has jurisdiction over the child. The legal label in Pakistan is guardianship under the Guardians and Wards Act, 1890 — not Western adoption. That is explained on the first WhatsApp, not after the certificate.

Punjab or Azad Jammu & Kashmir — not the same court

A large share of British Pakistani families trace back to Mirpur, Kotli and Bhimber. Azad Jammu & Kashmir runs its own court structure, separate from the Punjab judiciary. If the child is in AJK the petition is filed there, not in Lahore. Tell us the district in the first WhatsApp and we will tell you which bench the file belongs in.

Apostille or High Commission — we confirm before you book

Pakistan has accepted apostilles from Convention countries since 9 March 2023, without onward attestation by MOFA or a Pakistani mission. In practice some courts, sub-registrars and NADRA counters still expect a power of attorney executed or attested at the Pakistan High Commission. We check what the specific forum will take before you pay for an appointment.

The order is not leave to enter the UK

A Pakistani guardianship certificate is not an adoption order and not entry clearance. UK entry for the child sits under the Home Office’s Appendix Adoption rules, and Pakistan is not a country whose adoption orders the UK recognises automatically — because Pakistani courts do not make adoption orders at all.

Process

How a UK file actually runs.

Four stages. The first two decide whether the rest is worth paying for.

01

Sequence check, before anything is filed

UK intercountry adoption guidance expects the UK-side assessment — local authority home study, and where the route requires it a Certificate of Eligibility — to be in place before a child is placed with you abroad. Filing in Pakistan first can make the UK end harder, not easier. We will ask what your UK adviser has said before we open a file.

02

Which court, which district

Jurisdiction follows where the child ordinarily resides. Punjab districts, Sindh, KP, Islamabad and Azad Jammu & Kashmir are not interchangeable. Getting this wrong costs months.

03

Power of attorney, signed where you live

Notarised in the UK and apostilled by the FCDO Legalisation Office, or executed at the Pakistan High Commission in London or the consulate covering your area. We send the exact wording and the route to use — the two are not always interchangeable in front of a Pakistani registrar.

04

Petition, welfare inquiry, certificate

Petition under the Guardians and Wards Act, 1890, notice to interested parties, a welfare report if the court orders one, hearings, and the guardianship certificate. Updates by WhatsApp in your evening, not ours.

The other side of the file

What the UK side does with a Pakistani order.

This is a plain description of published UK guidance, not our advice on UK law. We are Pakistani counsel. Take UK immigration and adoption advice from a UK adviser.

A

Pakistan is guardianship-only, so there is no adoption order to recognise

The UK recognises certain overseas adoption orders automatically under the Adoption (Recognition of Overseas Adoptions) Order 2013. Pakistan does not sit in that group, for the simple reason that Pakistani Family Courts appoint guardians under a 19th-century statute rather than making adoption orders. Families are therefore routed to the other parts of Appendix Adoption.

B

“Coming to the UK for adoption” and “de facto adoption” are the two routes UK advisers usually name

The first brings a child to the UK to be adopted here, on the back of a UK adoption assessment. The second recognises a parent-child relationship formed abroad, and the rules set a substantial qualifying period of the family actually living with and caring for the child overseas — commonly described as eighteen months, including the twelve immediately before the application. Reported tribunal decisions turn on that period and on whether ties to the birth family genuinely ended.

C

The Pakistani file should be built with the UK evidence in mind

Home Office caseworkers look for reliable documents showing parental responsibility, why the birth parents or current carers cannot care for the child, and that the arrangement is genuine. Those are the same facts a Family Court in Pakistan weighs. Pleaded properly once, the Pakistani record does double duty later.

Working with Lahore

Four hours, five in winter.

  • Lahore is UTC+5 and does not change — Pakistan has no daylight saving. That puts us four hours ahead of the UK in British Summer Time and five hours ahead in GMT.
  • A 2:00 PM call in Lahore is 10:00 AM in London in summer, 9:00 AM in winter. Hearings happen in our morning, so a same-day update typically lands with you before UK lunchtime.
  • WhatsApp is read Monday to Saturday, 9:00 AM to 6:00 PM PKT. A Sunday evening message in Manchester is answered Monday morning in Lahore.
Questions we get from UK

Straight answers.

Is a Pakistani guardianship order an adoption order in the UK?

No. Pakistani Family Courts appoint guardians under the Guardians and Wards Act, 1890; they do not make adoption orders, so there is no Pakistani adoption order for the UK to recognise. UK entry for the child is dealt with under Appendix Adoption of the Immigration Rules, separately from anything a Pakistani court does.

Should I apply in Pakistan first, or start with my local authority?

Ask your UK adviser before you instruct anyone in Pakistan. UK intercountry adoption guidance expects the UK assessment to be completed before a child is placed with you abroad, and starting in the wrong order can damage the UK application. KBL & Associates will ask what your UK adviser has said before opening a file.

Does my power of attorney need an apostille or Pakistan High Commission attestation?

Pakistan acceded to the Hague Apostille Convention with effect from 9 March 2023, so a document apostilled in the UK is accepted in Pakistan without further attestation by MOFA or a Pakistani mission. In day-to-day practice some courts and registrars still prefer a power of attorney executed at the Pakistan High Commission. We confirm what the particular forum will accept before you book an appointment.

The child lives in Mirpur, not Punjab. Does that change the case?

Yes. Azad Jammu & Kashmir has its own court structure, separate from the Punjab judiciary, so the petition is filed and argued there rather than in Lahore. Tell us the district at the outset; it changes the forum, the timetable and the travel involved.

Do I have to fly to Pakistan for the hearings?

Usually not for the court file itself. With an attested power of attorney a Lahore advocate can appear, although the judge can require personal attendance in a particular case. Note that the UK routes may separately require you to have lived with the child abroad, which is a different question from court attendance.
