For Pakistanis in the UK

Khula, talaq and custody in Pakistan when you live in the United Kingdom.

For British Pakistani spouses and parents whose marriage was registered in Pakistan, or whose spouse or children are there, and who need the Pakistani side done properly.

Short answer. A wife in the UK can seek khula or dissolution in a Pakistani Family Court through a special attorney; the court tries reconciliation first and can take her statement by video link. A husband in the UK can have talaq notice under section 7 of the Muslim Family Laws Ordinance, 1961 served on the Union Council and the wife through an attorney. Whether England and Wales recognise the result is a question of UK law.

Three things that change a UK family case.

Recognition in the UK is a separate question

How a Pakistani khula or talaq is treated in England and Wales depends on UK law and on how the divorce was obtained. If you plan to remarry in the UK, or a visa depends on your status, get UK family-law advice before relying on Pakistani papers.

Children: the UK–Pakistan protocol

The UK and Pakistan have a judicial protocol on children matters. Where a child has been taken to or kept in Pakistan, custody is decided in Pakistan on the child’s welfare under the Guardians and Wards Act, 1890. Move quickly; delay weighs against you.

The NADRA record follows you

The Union Council certificate and NADRA divorce certificate feed your NICOP and your children’s documents. A divorce done informally can leave you shown as married for years. We finish the paperwork, not just the case.

How the file runs from the United Kingdom.

You stay where you are. We appear in Lahore on your power of attorney; a court can still ask for you by video link at a particular stage.

01

Where was the nikah registered?

The Union Council of registration, where your spouse now lives and where the children are decide the forum. Send the nikah nama first.

02

Special power of attorney from the UK

Signed through NADRA online, the High Commission in London or a consulate, or a UK notary plus FCDO apostille, limited to the family case.

03

Notice or suit

For talaq: written notice under section 7 of the Muslim Family Laws Ordinance, 1961 to the Union Council chairman and the wife. For khula or dissolution: a suit in the Family Court, which must try reconciliation first.

04

Certificate and records

Union Council certificate or Family Court decree, then the NADRA divorce certificate and a corrected marital status — which matter later for NICOPs and children’s documents.

A typical UK file.

A woman in east London was married in Gujranwala. Her husband stays in Pakistan, will not divorce and will not respond. She cannot take weeks off to sit in a Pakistani court.

She signs a special power of attorney limited to the family case. We file a suit for khula in the Family Court with jurisdiction, claim her dower, and ask for her statement to be recorded by video link. After the reconciliation stage fails, the court decrees khula; we take the decree to the Union Council and obtain the NADRA divorce certificate. Her UK solicitor advises separately on recognition in England.

Illustrative example, not a client file. Timelines depend on the court, the district and the other side.

Document route from the United Kingdom.

The single most expensive mistake overseas clients make is paying for the wrong signing route.

  • Notary plus apostille. Sign before a UK notary, then an apostille from the FCDO Legalisation Office. The Apostille Convention operates between the United Kingdom and Pakistan, so no further attestation by a Pakistani mission is legally needed — though some registrars still prefer a mission-attested document, and we check first.
  • NADRA online power of attorney. For CNIC, NICOP and POC holders at poa.nadra.gov.pk: biometrics for you and two witnesses, online payment, and an online interview with the mission you select. No visit.
  • In person at a mission. The Pakistan High Commission in London, or the consulates in Birmingham, Bradford, Manchester and Glasgow. The route for anyone with no Pakistani identity document who does not want the notary route.
  • Documents issued in the UK — a death certificate, a decree, a deed poll — are apostilled by the FCDO Legalisation Office before use in Pakistan.

What we will ask for

  • Nikah nama, with the Union Council registration details.
  • Both spouses’ CNIC, NICOP or passport copies.
  • Children’s B-forms or birth certificates, if custody is involved.
  • Any earlier notice, decree or Union Council correspondence.
  • Your current address abroad, and your spouse’s last known address.

Time difference with Lahore.

  • Lahore is 4 hours ahead of the UK in summer (BST) and 5 hours ahead in winter (GMT). Pakistan does not change its clocks.
  • A 10:00 AM hearing in Lahore is 5:00 AM in London in winter and 6:00 AM in summer, so the day’s update is usually with you before UK lunchtime.
  • The easiest window for a call is your morning: 9:00–11:00 AM in London is 2:00–4:00 PM in Lahore in winter, 1:00–3:00 PM in summer.
  • WhatsApp is read Monday to Saturday, 9:00 AM to 6:00 PM Pakistan time. Fees are quoted in writing before any work starts.

Questions from the UK.

Can I get khula from a Pakistani court while living in the UK?

Often, yes. The suit is filed through a special attorney, and Family Courts increasingly allow statements by video link. The court must attempt reconciliation first and can then decree khula, sometimes ordering return of dower. The judge can still require your personal appearance.

I am in the UK and want to divorce my wife in Pakistan. How does talaq become effective?

Written notice under section 7 of the Muslim Family Laws Ordinance, 1961 goes to the Union Council chairman with a copy to the wife, through your attorney. An arbitration council attempts reconciliation, and the talaq takes effect after ninety days unless revoked. The Union Council then issues its certificate.

Will my Pakistani divorce be recognised in England?

That is decided by UK law, not Pakistani law. It often depends on how the divorce was obtained and where each spouse lived. We make sure the Pakistani side is correct and documented; take advice from a UK family solicitor on recognition.

My child has been taken to Pakistan by the other parent. What can I do from the UK?

Act immediately. A custody or habeas petition can be filed in Pakistan, where the court decides on the child’s welfare. The UK–Pakistan judicial protocol on children matters may also apply; your UK lawyer should run the UK side in parallel.
