Pakistan property lawyer for owners living in Canada.
For Pakistani-Canadians whose house, plot or land in Pakistan is occupied by a relative, a tenant or a qabza group, or has been transferred behind their back.
Short answer. An owner living in Canada can usually recover occupied property in Punjab without travelling. A Lahore advocate files under a special power of attorney signed through NADRA online, at the High Commission or a consulate general, or before a Canadian notary with an apostille — in Punjab’s special court for overseas Pakistanis’ property, under the Illegal Dispossession Act, 2005, or by civil suit for possession and cancellation.

Three things that change a Canadian owner’s case.
Old Canadian documents may need redoing
The Apostille Convention entered into force for Canada on 11 January 2024. A power of attorney signed before then went through authentication and legalisation. If your attorney is still acting on an older document, we check it is still accepted and still says what you want.
West of Ontario there is no Pakistani mission
Pakistan’s missions are in Ottawa, Toronto and Montreal. From Calgary, Edmonton or Vancouver the practical routes are NADRA online or a local notary with the Alberta or British Columbia apostille.
Agricultural land needs the revenue record
Many Canadian families hold farmland in Punjab. The fard from the Arazi Record Centre and the khasra and khewat numbers drive the case. We pull the current record before anything is filed.
How the file runs from Canada.
You stay where you are. We appear in Lahore on your power of attorney; a court can still ask for you by video link at a particular stage.
Send the paper trail on WhatsApp
Registry deed, fard, mutation, society allotment or transfer letter, your CNIC, NICOP or POC, and any power of attorney you have ever signed. Photos are enough to start.
We check the record first
We pull the current fard or Arazi Record Centre print and the society or development authority file. If the record has already been changed, the case and the court are different.
One special power of attorney, signed in Canada
Drafted for this property and this case only. Signed through NADRA online, the High Commission in Ottawa or a consulate general, or a Canadian notary plus apostille.
Freeze, then file
Legal notice, a request to the registrar or society to note the dispute, and an injunction application to stop onward transfers — then the complaint or suit in the right forum.
A typical Canadian file.
A family in Calgary owns agricultural land near Sargodha. A relative has changed the mutation into his own name on documents the family never signed.
The owner signs a special power of attorney through NADRA online, naming the land by khasra numbers and this dispute only. We obtain the mutation file, apply for an injunction to stop any onward sale, and file a suit for declaration and cancellation of the mutation, with a criminal complaint for forgery. Calls happen in his evening, which is our morning.
Illustrative example, not a client file. Timelines depend on the court, the district and the other side.
Document route from Canada.
The single most expensive mistake overseas clients make is paying for the wrong signing route.
- Notary plus apostille. Sign before a Canadian notary, then an apostille from Global Affairs Canada, or from the competent authority in Alberta, British Columbia, Ontario, Quebec or Saskatchewan for documents signed there. The Apostille Convention operates between Canada and Pakistan, so no further attestation by a Pakistani mission is legally needed — though some registrars still prefer a mission-attested document, and we check first.
- NADRA online power of attorney. For CNIC, NICOP and POC holders at poa.nadra.gov.pk: biometrics for you and two witnesses, online payment, and an online interview with the mission you select. No visit.
- In person at a mission. The High Commission of Pakistan in Ottawa, or the consulates general in Toronto and Montreal. The route for anyone with no Pakistani identity document who does not want the notary route.
- Canadian documents signed or issued on or after 11 January 2024 can be apostilled. Anything older went through authentication and legalisation, and we check whether it still works or has to be redone.
What we will ask for
- Proof of title: registered sale deed, gift deed or inheritance mutation; for society plots, the allotment or transfer letter and file number.
- Current fard or Arazi Record Centre print if you have one — we can obtain it.
- Your CNIC, NICOP or POC, and passport pages showing you live in Canada.
- Every power of attorney you have signed for the property, and any revocation.
- Recent photos or video of the property and the names of the occupiers, if known.
Time difference with Lahore.
- Lahore is 10 hours ahead of Toronto in winter and 9 in summer, 12 and 11 ahead of Calgary, 13 and 12 ahead of Vancouver. Pakistan does not change its clocks.
- Our office day starts at 11:00 PM Toronto time in winter (midnight in summer). Hearings happen in your night and the summary is on WhatsApp by morning.
- In Toronto, 7:00 AM is 5:00 PM in Lahore in winter. In Vancouver, an 8:00 PM call in winter (9:00 PM in summer) is 9:00 AM the next day in Lahore.
- WhatsApp is read Monday to Saturday, 9:00 AM to 6:00 PM Pakistan time. Fees are quoted in writing before any work starts.
Questions from Canada.
Usually not. With a power of attorney signed through NADRA online, at the High Commission in Ottawa or a consulate general in Toronto or Montreal, or before a Canadian notary with an apostille, a Lahore advocate files and appears for you. The court may still ask for you by video link.
There is no Pakistani mission in British Columbia. Use NADRA’s online system if you hold a CNIC, NICOP or POC, or sign before a BC notary and have it apostilled by the British Columbia competent authority.
A document properly authenticated and legalised under the old system remains a document. Whether a particular sub-registrar or society will act on it now, and whether its terms still suit you, is a different question. We review it before your attorney uses it.
A Canadian lawyer can advise on Canadian law, but the case must be filed and argued in a Pakistani court by a Pakistani advocate. We handle the Pakistani side only.
