For Pakistanis in Canada

Khula, talaq and custody in Pakistan when you live in Canada.

For Pakistani-Canadian spouses and parents whose marriage was registered in Pakistan, or whose spouse or children are there.

Short answer. A wife in Canada can seek khula or dissolution in a Pakistani Family Court through a special attorney, with her statement by video link if the court allows. A husband in Canada can serve talaq notice under section 7 of the Muslim Family Laws Ordinance, 1961 through an attorney. Recognition of the result in Canada is decided under Canadian law, and Quebec has its own rules.

Three things that change a Canadian family case.

Recognition is a Canadian question

Whether Canada recognises a Pakistani khula or talaq depends on Canadian law and how the divorce was obtained. If you plan to remarry or sponsor a spouse, get Canadian advice before relying on Pakistani papers.

Quebec is different

Quebec’s civil-law system has its own rules on recognising foreign family orders. If you live in Quebec, take Quebec advice on the effect of a Pakistani decree there.

Travel with children

Where one parent is in Canada and the children are in Pakistan, Pakistani Family Courts decide custody and travel on welfare under the Guardians and Wards Act, 1890, and can make video-contact orders for the parent abroad.

How the file runs from Canada.

You stay where you are. We appear in Lahore on your power of attorney; a court can still ask for you by video link at a particular stage.

01

Where was the nikah registered?

The Union Council of registration, where your spouse now lives and where the children are decide the forum. Send the nikah nama first.

02

Special power of attorney from Canada

Signed through NADRA online, the High Commission in Ottawa or a consulate general, or a Canadian notary plus apostille, limited to the family case.

03

Notice or suit

For talaq: written notice under section 7 of the Muslim Family Laws Ordinance, 1961 to the Union Council chairman and the wife. For khula or dissolution: a suit in the Family Court, which must try reconciliation first.

04

Certificate and records

Union Council certificate or Family Court decree, then the NADRA divorce certificate and a corrected marital status — which matter later for NICOPs and children’s documents.

A typical Canadian file.

A woman in Brampton was married in Lahore. Her husband has returned to Pakistan and stopped all contact and support.

She signs a special power of attorney at the consulate general in Toronto. We file for khula in the Lahore Family Court, claim maintenance and her dower, and ask for her statement by video link. The decree goes to the Union Council and NADRA for the divorce certificate. Her Ontario family lawyer advises separately on recognition in Canada.

Illustrative example, not a client file. Timelines depend on the court, the district and the other side.

Document route from Canada.

The single most expensive mistake overseas clients make is paying for the wrong signing route.

  • Notary plus apostille. Sign before a Canadian notary, then an apostille from Global Affairs Canada, or from the competent authority in Alberta, British Columbia, Ontario, Quebec or Saskatchewan for documents signed there. The Apostille Convention operates between Canada and Pakistan, so no further attestation by a Pakistani mission is legally needed — though some registrars still prefer a mission-attested document, and we check first.
  • NADRA online power of attorney. For CNIC, NICOP and POC holders at poa.nadra.gov.pk: biometrics for you and two witnesses, online payment, and an online interview with the mission you select. No visit.
  • In person at a mission. The High Commission of Pakistan in Ottawa, or the consulates general in Toronto and Montreal. The route for anyone with no Pakistani identity document who does not want the notary route.
  • Canadian documents signed or issued on or after 11 January 2024 can be apostilled. Anything older went through authentication and legalisation, and we check whether it still works or has to be redone.

What we will ask for

  • Nikah nama, with the Union Council registration details.
  • Both spouses’ CNIC, NICOP or passport copies.
  • Children’s B-forms or birth certificates, if custody is involved.
  • Any earlier notice, decree or Union Council correspondence.
  • Your current address abroad, and your spouse’s last known address.

Time difference with Lahore.

  • Lahore is 10 hours ahead of Toronto in winter and 9 in summer, 12 and 11 ahead of Calgary, 13 and 12 ahead of Vancouver. Pakistan does not change its clocks.
  • Our office day starts at 11:00 PM Toronto time in winter (midnight in summer). Hearings happen in your night and the summary is on WhatsApp by morning.
  • In Toronto, 7:00 AM is 5:00 PM in Lahore in winter. In Vancouver, an 8:00 PM call in winter (9:00 PM in summer) is 9:00 AM the next day in Lahore.
  • WhatsApp is read Monday to Saturday, 9:00 AM to 6:00 PM Pakistan time. Fees are quoted in writing before any work starts.

Questions from Canada.

Can I get khula from a Pakistani court while living in Canada?

Often, yes. The suit is filed through a special attorney and Family Courts increasingly take statements by video link. The court attempts reconciliation first; the judge can still require your personal appearance.

I live in Canada. How do I divorce my wife in Pakistan?

Written notice of talaq under section 7 of the Muslim Family Laws Ordinance, 1961 goes to the Union Council chairman with a copy to your wife, through your attorney. An arbitration council attempts reconciliation, and the talaq takes effect after ninety days unless revoked.

Will Canada recognise my Pakistani divorce?

That is decided under Canadian law, and Quebec has its own rules. It often turns on how the divorce was obtained and where each spouse lived. We make the Pakistani side correct; take Canadian family-law advice on recognition.

My spouse has taken the children to Pakistan. What can I do from Canada?

Act quickly. A custody or habeas petition can be filed in Pakistan, where the court decides on the children’s welfare. Ask your Canadian lawyer in parallel whether any treaty route applies between Canada and Pakistan.
