Khula, talaq and custody in Pakistan when you live in the United States.
For Pakistani-American spouses and parents whose marriage was registered in Pakistan, or whose spouse or children are there.
Short answer. A wife in the US can seek khula or dissolution in a Pakistani Family Court through a special attorney, with her statement by video link if the court allows. A husband in the US can serve talaq notice under section 7 of the Muslim Family Laws Ordinance, 1961 through an attorney. How a US state treats the Pakistani result is for US law; how Pakistan treats a US divorce decree is a separate question we can answer.

Three things that change a US family case.
Divorced in a US court, still married on NADRA
A US decree does not update the Union Council or NADRA record by itself. Your NICOP and your children’s documents can keep showing you as married. We advise on what the Pakistani side needs to correct the record.
Recognition is for your state
Whether a Pakistani khula or talaq is recognised in the US is decided under the law of the state where you rely on it. Take advice from a family lawyer there before remarrying or filing an immigration petition.
Children in Pakistan
Custody in Pakistan is decided on the child’s welfare under the Guardians and Wards Act, 1890. Hague Abduction Convention routes work only between countries that have accepted each other; we check the current status before relying on it, and otherwise file custody or habeas in Pakistan.
How the file runs from the United States.
You stay where you are. We appear in Lahore on your power of attorney; a court can still ask for you by video link at a particular stage.
Where was the nikah registered?
The Union Council of registration, where your spouse now lives and where the children are decide the forum. Send the nikah nama first.
Special power of attorney from the US
Signed through NADRA online, the Embassy in Washington DC or a consulate general, or a US notary plus a state apostille, limited to the family case.
Notice or suit
For talaq: written notice under section 7 of the Muslim Family Laws Ordinance, 1961 to the Union Council chairman and the wife. For khula or dissolution: a suit in the Family Court, which must try reconciliation first.
Certificate and records
Union Council certificate or Family Court decree, then the NADRA divorce certificate and a corrected marital status — which matter later for NICOPs and children’s documents.
A typical US file.
A husband in Virginia has decided to end his marriage. His wife lives with her parents in Sialkot, where the nikah was registered.
He signs a special power of attorney at the Embassy in Washington DC. We serve written notice under section 7 on the Union Council chairman in Sialkot and on the wife, attend the arbitration council, and after ninety days obtain the Union Council certificate and the NADRA divorce certificate. Dower and maintenance are settled in writing. His US lawyer advises separately on recognition in Virginia.
Illustrative example, not a client file. Timelines depend on the court, the district and the other side.
Document route from the United States.
The single most expensive mistake overseas clients make is paying for the wrong signing route.
- Notary plus apostille. Sign before a US notary, then an apostille from the Secretary of State of the state where that notary is commissioned. The Apostille Convention operates between the United States and Pakistan, so no further attestation by a Pakistani mission is legally needed — though some registrars still prefer a mission-attested document, and we check first.
- NADRA online power of attorney. For CNIC, NICOP and POC holders at poa.nadra.gov.pk: biometrics for you and two witnesses, online payment, and an online interview with the mission you select. No visit.
- In person at a mission. The Embassy of Pakistan in Washington DC, or the consulates general in New York, Chicago, Houston and Los Angeles. The route for anyone with no Pakistani identity document who does not want the notary route.
- Documents issued in the US — a state death certificate, a court decree — are apostilled by the Secretary of State of the state that issued them, so a Texas certificate goes to Texas, not to the state where you now live.
What we will ask for
- Nikah nama, with the Union Council registration details.
- Both spouses’ CNIC, NICOP or passport copies.
- Children’s B-forms or birth certificates, if custody is involved.
- Any earlier notice, decree or Union Council correspondence.

Time difference with Lahore.
- Lahore is 10 hours ahead of New York in winter and 9 in summer; 11 and 10 ahead of Houston and Chicago; 13 and 12 ahead of Los Angeles. Pakistan does not change its clocks.
- Our office day, 9:00 AM to 6:00 PM in Lahore, starts at 11:00 PM Eastern in winter (midnight in summer). Hearings happen in your night; the WhatsApp summary is waiting when you wake up.
- For a live call on the East Coast, book early: 7:00 AM Eastern is 5:00 PM in Lahore in winter, 4:00 PM in summer. On the West Coast, an 8:00 PM Pacific call in winter (9:00 PM in summer) is 9:00 AM the next day in Lahore.
- WhatsApp is read Monday to Saturday, 9:00 AM to 6:00 PM Pakistan time. Fees are quoted in writing before any work starts.
Questions from the US.
Often, yes. The suit is filed in the Family Court through a special attorney and statements can be taken by video link where the court allows. Reconciliation is attempted first; the judge can still require your personal appearance.
Written notice under section 7 of the Muslim Family Laws Ordinance, 1961 is given to the Union Council chairman with a copy to the wife, through your attorney. An arbitration council attempts reconciliation and the talaq takes effect after ninety days unless revoked.
Usually, yes, if you hold a NICOP, intend to remarry in Pakistan, or your children’s Pakistani documents depend on it. The US decree does not update the Union Council or NADRA record by itself. We advise on the Pakistani steps.
That is decided under the law of the US state where you rely on it. We make sure the Pakistani side is correct and documented; take advice from a family lawyer in your state on recognition.
