For Pakistanis in Australia

Khula, talaq and custody in Pakistan when you live in Australia.

For Pakistani-Australian spouses and parents whose marriage was registered in Pakistan, or whose spouse or children are there.

Short answer. A wife in Australia can seek khula or dissolution in a Pakistani Family Court through a special attorney, with her statement by video link if the court allows — usually in her afternoon. A husband in Australia can serve talaq notice under section 7 of the Muslim Family Laws Ordinance, 1961 through an attorney. Recognition in Australia is a question of Australian law.

Three things that change an Australian family case.

Video statements in your afternoon

Lahore Family Courts sit in our morning, which is your early afternoon. A video statement does not mean a 3 AM call, unlike for clients in the Americas.

Recognition is Australian law

Whether Australia recognises a Pakistani khula or talaq is decided under Australian law. Before remarrying or sponsoring a partner, take advice from an Australian family lawyer.

Children in Pakistan

Custody in Pakistan is decided on welfare under the Guardians and Wards Act, 1890. Ask your Australian lawyer whether any treaty route applies between Australia and Pakistan; otherwise the remedy is a custody or habeas petition in Pakistan.

How the file runs from Australia.

You stay where you are. We appear in Lahore on your power of attorney; a court can still ask for you by video link at a particular stage.

01

Where was the nikah registered?

The Union Council of registration, where your spouse now lives and where the children are decide the forum. Send the nikah nama first.

02

Special power of attorney from Australia

Signed through NADRA online, the High Commission in Canberra or the Consulate General in Sydney, or a notary public plus DFAT apostille, limited to the family case.

03

Notice or suit

For talaq: written notice under section 7 of the Muslim Family Laws Ordinance, 1961 to the Union Council chairman and the wife. For khula or dissolution: a suit in the Family Court, which must try reconciliation first.

04

Certificate and records

Union Council certificate or Family Court decree, then the NADRA divorce certificate and a corrected marital status — which matter later for NICOPs and children’s documents.

A typical Australian file.

A woman in Melbourne was married in Faisalabad. Her husband lives in Pakistan and refuses to divorce or support her.

She signs a special power of attorney through NADRA online. We file for khula in the Family Court, claim maintenance and dower, and ask for her statement by video link, which the court records in her early afternoon. The decree goes to the Union Council and NADRA. Her Australian lawyer advises separately on recognition.

Illustrative example, not a client file. Timelines depend on the court, the district and the other side.

Document route from Australia.

The single most expensive mistake overseas clients make is paying for the wrong signing route.

  • Notary plus apostille. Sign before an Australian notary public, then an apostille from the Department of Foreign Affairs and Trade (DFAT). The Apostille Convention operates between Australia and Pakistan, so no further attestation by a Pakistani mission is legally needed — though some registrars still prefer a mission-attested document, and we check first.
  • NADRA online power of attorney. For CNIC, NICOP and POC holders at poa.nadra.gov.pk: biometrics for you and two witnesses, online payment, and an online interview with the mission you select. No visit.
  • In person at a mission. The High Commission of Pakistan in Canberra, or the Consulate General in Sydney. The route for anyone with no Pakistani identity document who does not want the notary route.
  • Documents issued in Australia — a death certificate from a state registry, a court order — are apostilled by DFAT before use in Pakistan.

What we will ask for

  • Nikah nama, with the Union Council registration details.
  • Both spouses’ CNIC, NICOP or passport copies.
  • Children’s B-forms or birth certificates, if custody is involved.
  • Any earlier notice, decree or Union Council correspondence.
  • Your current address abroad, and your spouse’s last known address.

Time difference with Lahore.

  • Sydney and Melbourne are 5 hours ahead of Lahore in winter and 6 hours ahead during Australian daylight saving; Brisbane stays 5 ahead; Perth is 3 ahead.
  • A 10:00 AM hearing in Lahore is 3:00 PM in Sydney (4:00 PM in daylight saving), so the result of the day usually reaches you before dinner.
  • Our office day is 2:00 PM to 11:00 PM in Sydney (3:00 PM to midnight in daylight saving) and 12:00 PM to 9:00 PM in Perth — easy to reach after work.
  • WhatsApp is read Monday to Saturday, 9:00 AM to 6:00 PM Pakistan time. Fees are quoted in writing before any work starts.

Questions from Australia.

Can I get khula from a Pakistani court while living in Australia?

Often, yes. The suit is filed through a special attorney and Family Courts increasingly take statements by video link. The court attempts reconciliation first; the judge can still require your personal appearance.

How does talaq become effective if I live in Australia?

Written notice under section 7 of the Muslim Family Laws Ordinance, 1961 goes to the Union Council chairman with a copy to the wife, through your attorney. An arbitration council attempts reconciliation, and the talaq takes effect after ninety days unless revoked.

Will Australia recognise my Pakistani divorce?

That is decided under Australian law, often depending on how the divorce was obtained and where each spouse lived. We make sure the Pakistani side is correct; take Australian family-law advice on recognition.

My child has been taken to Pakistan. What can I do from Australia?

Act quickly. A custody or habeas petition can be filed in Pakistan, where the court decides on the child’s welfare. Ask your Australian lawyer in parallel whether a treaty route applies.
